When to use it

Use when a plaintiff firm prepares the bundle for a medical assessment in the Personal Injury Commission. The lawyer lodges the application or reply. Do not send the index to the medical assessor.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool may index the lawyer's documents and list the matters the lawyer has written, and the lawyer writes the lodged application or reply.

AI may

  • Assemble the index from the documents the lawyer has selected, with one page sequence.
  • Insert the pathway or forum block the lawyer has selected and remove the others.

AI must not

  • Must not state an impairment percentage, a diagnosis, or whether a statutory threshold is met.
  • Must not put health or wage records into a public or consumer tool.
  • Must not draft an affidavit, a witness statement or a statutory declaration.
  • Must not communicate with the medical assessor or draft a letter to the assessor.
  • Must not put legal submissions into a workers compensation bundle.
  • Must not state an impairment percentage or a threshold result.

The lawyer checks

  • One division remains, and the bundle is indexed, paginated, free of duplicates and within 500 pages, or an additional-documents application is identified.
  • In workers compensation, the section 289(3) gateway and any liability dispute have been checked.
  • In motor accidents, the Motor Accident Guidelines clauses named in PIC6 have been read.
  • Surveillance is included only if an order allows it.

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
