When to use it
Use before a lump sum compensation settlement is agreed, where the person receives, or has claimed, an income support payment. The Social Security Act was not opened. Do not invent the dollar limit.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may enter dates and dollar figures the lawyer takes from the deed or the judgment. The lawyer decides which amount is the lump sum and whether the hearing was contested.
AI may
- Record the date of injury, the date periodic payments stopped, and the date of settlement from the file
- Record each lump sum the deed or judgment names, and whether the lawyer has marked it as loss of earnings
- Leave the income-test limit blank until Services Australia or the lawyer inserts the limit at the settlement date
AI must not
- Must not state a dollar figure for the single-rate pension income-test limit
- Must not decide that a head of damage is loss of earnings
- Must not tell the client they will be paid during the period
The lawyer checks
- Whether the lump sum was awarded by a court or tribunal after a contested hearing
- Whether more than one lump sum is for the same injury and at least one has a loss of earnings
- The person has told Services Australia, if they get a payment or have claimed one
