When to use it

Use when a plaintiff firm accepts instructions on an injury or death claim in Victoria, Queensland or New South Wales. The lawyer decides whether to act. The checklist records the steps that follow that decision.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool may turn the intake into a checklist of gaps, and a lawyer checks conflicts, disclosure and the decision to act before the file is opened.

AI may

  • List identity, date and document gaps from the intake note
  • Prepare the diary table from facts and provisions the lawyer has named
  • Mark whether a costs disclosure, an authority and a health-information consent are on the file

AI must not

  • Must not tell the person they have a claim, or decide whether the firm will act
  • Must not choose a costs figure, a threshold amount, or an uplift percentage
  • Must not write into a statutory declaration on a notice or claim form
  • Must not put health information into a tool before the consent and the approved-tool check are done

The lawyer checks

  • Conflicts under the current conduct rules are cleared, or the lawyer has recorded why the firm will not act
  • Costs disclosure uses the Uniform Law in New South Wales and Victoria, and the Legal Profession Act 2007 in Queensland, with the current threshold read rather than remembered
  • The diary's controlling date is still blank until the lawyer marks it
