Where this comes from

The official form is published by courts.qld.gov.au; this page is a completion guide. Last checked on 2026-10-23.

When to use it

Use when a Queensland personal-injury compromise for a child or another person under a legal disability is to be sanctioned under the Public Trustee Act 1978, section 59, in the District Court or, by that practice direction, the Supreme Court. The tool does not draft the affidavits, the opinion, or the amounts.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may check the practice-direction checklist against documents already on the file; it writes nothing in an affidavit, opinion or order, and the lawyer settles every word that will be filed or sworn.

AI may

  • Check the practice-direction checklist against documents already on the file and list what is missing
  • Record whether the draft order is marked Form 59 under rule 661, without writing the amounts
  • Note the cases the practice direction cites, without adding any other case

AI must not

  • Must not write affidavit text, the barrister or solicitor opinion, or the figures in the order
  • Must not write allegations, grounds or orders in words that will be filed
  • Must not sign, file or serve the application

The lawyer checks

  • The plaintiff is under a legal disability and section 59(1) or 59(2) of the Public Trustee Act 1978 is the sanction power
  • The current practice direction and its annexed Form 59 order are used
  • The opinion and the costs affidavit are sealed and not served, and the defendant receives a draft order only
  • A child who may lack capacity at 18 is considered for the QCAT direction the order's note describes

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
