When to use it

Use when a person, a representative, or the relevant CTP insurer disputes a Lifetime Care decision on interim or lifetime participation, within six months of receiving it, or asks in writing for a review of an assessment panel decision. Do not use it for the interim application, or for a motor-accident-injury dispute that the page says cannot be appealed.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool may prepare the dispute letter or the panel-review letter from dates and reports already on the file, and the lawyer chooses the ground and settles every reason.

AI may

  • Record whether the decision is interim participation or lifetime participation, and the date it was received
  • Keep a medical eligibility dispute separate from a dispute about whether the injury is a motor accident injury
  • For a panel review, tie each reason to one of the four grounds on the disputes page and index the reports that support it

AI must not

  • Must not complete the interim application, the consent, or the specialist's medical certificate
  • Must not ask for an appeal of a motor accident injury dispute. The page says that decision is legally binding and the legislation gives no appeal
  • Must not invent a Lifetime Care and Support Guidelines clause number. The Guidelines were not opened
  • Must not treat this letter as a CTP statutory-benefits claim, an insurer internal review under the motor accidents or workers compensation Acts, or an Independent Review Office complaint

The lawyer checks

  • A dispute of interim participation (the initial two years) or lifetime participation uses the same process. Lodge it within six months of receiving the decision. The heading also says within 6 months of the decision. Use the received date, and note the heading
  • It may be lodged verbally, in person or by phone, or in writing by letter or email, by the person, a representative (family member, solicitor or advocate), or the relevant CTP insurer
  • Medical eligibility is whether the injury meets the Lifetime Care and Support Guidelines. Three independent assessors are appointed. None has assessed or treated the person before. The certificate goes to the person and to icare at the same time. It is binding, and a review is available
  • A motor accident injury dispute is whether the injury meets the legal definition of a motor accident. The page describes legal professionals and, later, claims assessors. It says the decision is legally binding and the legislation gives no appeal
  • A panel review is only on a ground the page lists: a later material change in condition; additional information unavailable before referral that could have a material effect; a decision not made under the Guidelines; or a decision that is demonstrably incorrect in a material respect
  • The person or the insurer applies in writing within six months of receiving the panel decision, with name, address, contact details, the decision date, reasons tied to a ground, and any reports
  • The other party has 20 days for submissions. Referral is decided within 10 days. Both sides are told within five days, with reasons. The review panel is three assessors, none from the original panel. A party has 10 days to object to those assessors
  • The first meeting is within 30 days. The panel considers the dispute afresh, must comply with the Guidelines, and confirms or revokes the decision. The certificate is issued within 20 working days of the last meeting
  • The Act text and the Guidelines were not opened. The who-we-care-for page says the scheme was established under the Motor Accidents (Lifetime Care and Support) Act 2006. No section is quoted
  • Health, wage and scheme records stay in the firm's approved tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).
