When to use it

Use for weekly statutory benefits after a New South Wales motor accident to which this Act applies. The lawyer decides earner status, fault and threshold injury. It is not a workers compensation worksheet.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool sets out the Schedule 1 average and the percentage in the entitlement period the lawyer selects, and leaves the declared maximum and the minimum for the lawyer.

AI may

  • Test the Schedule 1 earner paths against the work history the lawyer marks.
  • Average gross earnings over the period clause 4 selects.
  • Apply 95, 80 or 85 per cent as sections 3.6, 3.7 and 3.8 state, then show the maximum and minimum comparisons with blanks for the indexed amounts.

AI must not

  • Do not type the amount printed in section 3.9(1). Section 3.9(5) says the declared amount applies to its exclusion.
  • Do not invent the minimum. Section 3.10 says the regulations prescribe it. They were not opened.
  • Do not decide most at fault, threshold injury, or a permanent-impairment percentage.
  • Do not apply section 3.38's reduction. The section was not opened. Section 3.11 only records that mostly at fault means contributory negligence greater than 61 per cent.

The lawyer checks

  • Decide whether the person is an earner under Schedule 1 clause 2, and whether a student or apprentice clause applies.
  • Insert the maximum from the order the Authority publishes on the NSW legislation website under section 3.9.
  • Insert the minimum prescribed by the regulations.
  • Decide fault, threshold injury and, where section 3.12 needs it, whether a damages claim is pending and the permanent impairment.
  • Keep wage and medical records in the firm's system. Check Australian Solicitors' Conduct Rules rule 9, Australian Privacy Principle 11, and whether a breach would be notifiable under the Privacy Act 1988 (Cth).

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
