When to use it

Use when a worker disagrees with a WorkSafe Agent or self-insurer decision, or the agent or self-insurer has not responded or has not paid within a reasonable time, and the firm sends the Application for Conciliation. Do not use it for a further conciliation after a Certificate of Dismissal, or for a Transport Accident Commission review.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool may prepare this covering letter and list the decision and the attachments already on the file, and the worker or the authorised helper completes and signs the form.

AI may

  • Diary 60 days from the date the decision was received, and flag a late application so a reason is included
  • Check that at least one of the documents the conciliation page lists is on the file
  • Record whether a lawyer will attend, so permission can be asked for

AI must not

  • Must not complete or sign the Application for Conciliation, including the part where a helper confirms the worker is happy for them to help
  • Must not use this letter for a further conciliation. That form was not opened
  • Must not say what outcome a conciliation conference will produce. The outcomes on the page are not set out in this letter
  • Must not treat this as a Transport Accident Commission informal review or as a VCAT application

The lawyer checks

  • The page says conciliation is informal and free. The worker, the WorkCover insurer (the WorkSafe Agent) or self-insurer, the employer, and representatives come together. It is an essential step before arbitration or court
  • Send the form within 60 days of receiving the decision. A late application can be considered if a reason is given. The page also allows an application where the agent or self-insurer has not responded to a request, or has not made a payment, within a reasonable time
  • Send at least one of: the decision; the request for treatment if there was no response; WorkCover medical certificates if weekly payments were not paid; invoices or receipts if medical treatment was not paid
  • Someone may apply for the worker. Their details go at the bottom of the form and they confirm the worker is happy for them to help. A lawyer who is to attend the conference needs the Commission's permission. A friend or family member can attend as a support person and can speak on the worker's behalf only if the Conciliation Officer is ok with this
  • Union Assist, for current and former union members who may be eligible, WorkCover Assist, another union or support service, or the worker's own lawyer, are the assistants the page names. The fact sheet, the service brochure and the assistance list were not opened
  • The form completion guide is a separate precedent. This letter does not replace the form
  • Health, wage and scheme records stay in the firm's approved tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).
