When to use it

Use when working out pre-injury average weekly earnings for a Victorian work injury under this Act. It does not set the weekly payment percentage. Sections 161 and 162 were not opened.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool lists the section 153 paths and the inclusions in sections 155 to 158, and leaves the enhancement arithmetic blank where the printed formula did not render.

AI may

  • Identify the relevant period under section 154 from the employment history the lawyer marks.
  • Add ordinary earnings under section 155 and exclude the section 156 items and employer superannuation.
  • Record A and B from section 157 and leave the enhancement result for the lawyer.

AI must not

  • Do not divide A by B, or use any other enhancement formula, unless it is the formula printed in section 157. The image did not render.
  • Do not state a weekly payment percentage. Sections 161 and 162 were not opened.
  • Do not calculate Schedule 2 classes or Schedule 1 deemed remuneration. Those schedules were not opened.
  • Do not sign a claim or a certificate.

The lawyer checks

  • Decide whether this Act, rather than an earlier accident compensation Act, applies.
  • Choose the section 153 path, including the less-than-4-weeks path and the full-time-seeker path.
  • Apply the printed section 157 formula.
  • Insert any Schedule 2 or Schedule 1 amount only after those schedules are read.
  • Keep wage and medical records in the firm's system. Check Australian Solicitors' Conduct Rules rule 9, Australian Privacy Principle 11, and whether a breach would be notifiable under the Privacy Act 1988 (Cth).
