When to use it

Use when an interim NIISQ participant is approaching the two-year anniversary and the firm asks the Agency to repeat the eligibility review. Do not use it to complete the interim-participant application, the insurer's application, or the medical certificate.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool may assemble the request and an index of reports already on the file, and the lawyer decides whether the person still meets the eligibility criteria and what is sent.

AI may

  • Draft the request with square-bracket gaps for the participant, the accident date, the interim acceptance date and the anniversary
  • Index medical reports already on the file, including every FIM or WeeFIM score the file already holds for a traumatic brain injury or severe burns
  • Record that a CTP insurer may apply where a CTP claim has been made, and that this letter is the participant's request for the anniversary review

AI must not

  • Must not complete the interim-participant application, the insurer application, the medical certificate, or the signed authority
  • Must not decide eligibility, or insert an ASIA grade, a FIM or WeeFIM score, a burn percentage or a vision measure unless the specialist's report already states it
  • Must not treat this letter as a compulsory third party damages claim or as the Workers' Compensation Regulator review
  • Must not draft the internal review form, a Medical Assessment Tribunal referral, or a QCAT application

The lawyer checks

  • The apply page says an eligible person is an interim participant for two years, and that before the two-year anniversary the eligibility review is repeated and the person is then told whether they are eligible for lifetime participation
  • The eligibility page says anyone with serious personal injuries from a motor vehicle accident in Queensland on or after 1 July 2016 may be eligible, and that the scheme is no-fault if the Act and Regulation criteria are met
  • The page's injury list is permanent spinal cord injuries, permanent injury to the brachial plexus, traumatic brain injuries, severe burns, multiple or high-level limb amputations, and permanent blindness caused by trauma. The page says the specific criteria are also in section 5 of the National Injury Insurance Scheme (Queensland) Regulation 2016. That regulation was not opened
  • The National Injury Insurance Scheme (Queensland) Act 2016 was not opened. No section of the Act is quoted
  • Traumatic brain injury or severe burns need a FIM, or a WeeFIM for a child, by a credentialed assessor. If there have been several assessments since the injury, the apply page says all scores should be submitted
  • The interim application form is a separate link precedent. This letter does not replace it
  • Health, wage and scheme records stay in the firm's approved tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).
