When to use it

Use when a plaintiff firm builds a dated treatment chronology from hospital, treating and medico-legal records. The library's protocol on AI-generated medical chronologies governs which tool may be used and the check of every row. This precedent is the table, not that protocol.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool may extract dated entries with a page reference from records already in an approved tool, and a person checks every row against that page before the chronology is used.

AI may

  • Extract the date, provider, setting, complaint or event, findings and treatment, each with the page it came from
  • Flag a missing date, an illegible page, two entries that describe the same day differently, and a gap between providers
  • Produce the verification log with a row for each batch

AI must not

  • Must not add a diagnosis, a cause, a breach or a prognosis that is not written on the cited page
  • Must not enter material produced on subpoena, under the implied undertaking, or under a suppression or statutory publication bar into a generative tool unless the responsible lawyer is satisfied of the conditions in Practice Note SC Gen 23 para 9A, where that note applies
  • Must not put health information into a public tool. Practice Note SC Gen 25 para 6.8 says confidential or sensitive information is not entered into a public AI tool
  • Must not generate the content of an affidavit, a witness statement or the words of the client's evidence. Practice Note SC Gen 23 para 10 prohibits that use

The lawyer checks

  • A named person has opened the cited page for every row that will be used, and has signed the verification log
  • Conflicts are left as two rows. They are not smoothed into one account
  • The chronology is labelled as a working document. Experts receive the source records
  • Health records stay in a firm-controlled tool. Check ASCR r 9, APP 11, and whether a breach is notifiable under the Privacy Act 1988 (Cth)

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
