When to use it

Use when the deed is ready to sign or has been signed, to tell the insurer or the defendant's solicitors where to pay and what clearance must come first. Do not use it to vary the deed.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may fill the deed date, the account and the notice dates from the file in a firm-controlled tool; the lawyer checks the letter against the signed deed and the Services Australia page before it is sent.

AI may

  • Insert the proceeding title, the deed date and the trust-account details the firm has supplied
  • State the 28-day Medicare date counted from the last date of signing, once that date is known
  • Attach only the documents the lawyer has marked for service

AI must not

  • Must not attach medical reports or counsel's opinion
  • Must not ask the payer to pay the client where sanction or approval is still required
  • Must not add a release, an admission or a costs term that is not in the deed

The lawyer checks

  • The letter matches the deed, including whether costs are additional or included
  • The Medicare paragraph matches the page: no part is paid to the injured person until the notice is sent and the charge or a valid advance is paid
  • If a court must approve the settlement, the letter says payment waits for the order and follows it
  • The account number is the firm's trust account, checked against the firm's own record

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
