Where this comes from

The official form is published by tac.vic.gov.au; this page is a completion guide. Last checked on 2026-10-23.

When to use it

Use when a lawyer is asking the TAC for a serious injury certificate so a client can claim common law damages. The form is completed on the TAC page. It is not the County Court originating motion.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool may assemble a document index and a list of injuries already recorded on the file for the lawyer to map to section 93(17); the lawyer completes the TAC form and settles every injury and every defendant.

AI may

  • Index reports and investigation material already on the file, with author and date
  • List injuries named in those reports so the lawyer can choose which section 93(17) subparagraph to tick
  • Check the draft against the form's prompts: application type, claim identifiers, authority, defendants and vehicles

AI must not

  • Must not decide that an injury is serious, or choose the section 93(17) subparagraph
  • Must not describe the accident, the negligence or the consequences in words that go into the form
  • Must not sign or upload the authority to release information
  • Must not treat the form as evidence: the TAC says it is without prejudice and cannot be relied on later in a court or tribunal unless agreed
  • Must not tick or write the declaration that tax file numbers have been redacted, or any answer about whether an affidavit has been sworn.

The lawyer checks

  • Application type matches the Protocols: standard (chapter 5), fast track (chapter 3), or a transport accident in the course of employment (clauses 5.4 to 5.10)
  • Name, date of birth and claim number match the TAC record exactly
  • Signed authority to release information (general) is uploaded, as clause 5.5.4 of the Common Law Protocols 2026 requires
  • Only the demonstrable serious injuries are listed, each against section 93(17)(a), (b), (c) or (d)
  • WorkCover status is answered, including whether a serious injury application has been or will be lodged with WorkCover
  • Health information stays in a firm-controlled tool. Check ASCR r 9, APP 11, and whether any disclosure would be a notifiable breach under the Privacy Act 1988 (Cth).
