When to use it

Use when a Queensland statutory weekly payment depends on normal weekly earnings. The lawyer identifies the employment in the period section 106 names. Partial-incapacity rates were not opened and are not on this sheet.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool records the section 106 period and the section 150 or 151 comparison, and leaves the regulation arithmetic and every indexed dollar for the lawyer.

AI may

  • List employment in the 12 months before the injury, or the shorter period if employment did not run that long.
  • Set out the section 150 or 151 comparison once the lawyer supplies normal weekly earnings and QOTE.
  • Apply the subsection (2) ceiling that was opened.

AI must not

  • Do not invent the regulation method. Section 106(3) says normal weekly earnings are calculated as prescribed under a regulation. That regulation was not opened.
  • Do not type a QOTE dollar. Section 10A tells the lawyer where the figure comes from, and the Regulator's notice is subordinate legislation.
  • Do not type a single pension rate. Its definition was not opened.
  • Do not calculate partial incapacity. Those sections were not opened.

The lawyer checks

  • Decide whether employment is governed by an industrial instrument, so that section 150 applies rather than section 151.
  • Take the calculation method from the current regulation.
  • Insert QOTE from the Regulator's notice for the financial year, made under section 10A.
  • Decide whether the worker has demonstrated that the injury could result in a DPI of more than 15 per cent. The tool does not.
  • Keep wage and medical records in the firm's system. Check Australian Solicitors' Conduct Rules rule 9, Australian Privacy Principle 11, and whether a breach would be notifiable under the Privacy Act 1988 (Cth).
