When to use it

Use when a Queensland motor accident claim has not settled at the compulsory conference, or the conference has been dispensed with and the offer is due within 14 days of that agreement or order. The client approves the amount. This is not the notice of accident claim and not the insurer's response to that notice.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool may assemble this offer from the client's written instructions, and the lawyer fixes the amount and the costs term before it is sent to the insurer.

AI may

  • Fill the parties, the claim and the client-approved amount into the offer
  • Flag an offer at or under the upper offer limit that is not expressed as exclusive of costs
  • Keep the statement that the offer stays open for 14 days and that proceedings are not started while it is open
  • Mark the offer as a section 51C offer so it is not confused with the notice of claim

AI must not

  • Must not choose or change the amount or the costs term
  • Must not describe this offer as the notice before action, or as the insurer's response to that notice
  • Must not insert dollar figures for the lower or upper offer limit, or a costs rule that was not read in section 51C
  • Must not file the offer except in the sealed envelope at the start of a proceeding, or tell the court its terms before the claim is decided

The lawyer checks

  • The client approved the amount in writing
  • Section 51C(1): each party exchanges written final offers at the conference, or within 14 days after the agreement or order dispensing with it, unless the court has dispensed with the obligation
  • Section 51C(3): an offer for the upper offer limit or less is exclusive of costs. The regulation and the dollar amounts of the limits were not opened
  • Section 51C(4) and (10) are the costs provisions that were read. No other costs section of this Act was opened
  • Section 51C(6): the offer stays open for 14 days and proceedings must not be started while it remains open
  • An insurer who denies liability altogether must still offer, expressed as $nil. That is the insurer's offer
  • If the claimant brings a proceeding, section 51C(7) requires a sealed envelope at the start. The insurer's envelope is filed before or at the defence. The court must not read the offers until it has decided the claim
  • The compulsory-conference section, and any rule for more than one insurer, were not in section 51C. Confirm them before the conference
  • This is not the notice of accident claim, and it is not the insurer's response to that notice. Sanction rules and statutory refunds were not opened
