Where this comes from

The official form is published by dustdiseasestribunal.nsw.gov.au; this page is a completion guide. Last checked on 2026-10-23.

When to use it

Use when a plaintiff starts an asbestos-related claim in the Dust Diseases Tribunal of New South Wales. The statement of claim is UCPR Form 3A or Form 3B. The particulars are the Tribunal's own form, not UCPR Form 14.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool writes nothing in the statement of claim, the affidavit verifying, or the Tribunal particulars, and it may only build a dust-exposure chronology from records already on the file.

AI may

  • Build a chronology of employment, dust exposure and diagnosis from records already on the file
  • List which of the statement of claim, the particulars and the filing fee are still outstanding
  • Record the online-registry retention dates the Tribunal page states, once the filing date is known

AI must not

  • Must not write the statement of claim, the affidavit verifying, or the plaintiff's statement of particulars
  • Must not treat the Tribunal's Form 1 in Schedule 2 as UCPR Form 1, or the reverse
  • Must not file or serve

The lawyer checks

  • File the statement of claim online, by post or in person, with the filing fee, then serve. Then file the Plaintiff's Statement of Particulars with a UCPR Form 1 cover, then serve
  • The Tribunal's particulars are Form 1 in Schedule 2 of the Regulation. The linked document filename includes valid_feb_09. That filename is not a commencement date. The document was not opened
  • Form 3A includes an affidavit verifying where the Rules require it. Practice Note SC Gen 23 paragraph 10 applies to that affidavit
  • The how-to-file page, last updated 11 June 2025, sets out UCPR rule 3.5 for documents uploaded to Online Registry, including the duty to file an original if the court requires it and the two-year retention periods in rule 3.5(9)
  • Advice to Practitioners No. 2 of 2013 may apply when the plaintiff is gravely ill. The advice itself was not opened
  • An unrepresented party needs leave under UCPR rule 7.3 before a subpoena issues
  • Health, wage and other personal information stays in a firm-controlled tool. Check confidentiality under ASCR r 9 and APP 11, and whether any breach is notifiable under the Privacy Act 1988 (Cth).

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
