Where this comes from

The official form is published by icare.nsw.gov.au; this page is a completion guide. Last checked on 2026-10-23.

When to use it

Use when an eligible worker, or an authorised representative, applies to Dust Diseases Care for care and support or for lung screening. The page says a solicitor is not required to make the application.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool may index employment, exposure and medical documents already on the file, and it writes nothing in the declaration and nothing in the worker's account of exposure.

AI may

  • Build a chronology of employers, dust types and dates from records already on the file
  • List identity documents, authorities and medical reports still missing
  • Check that names and dates of birth on uploads match the identity documents

AI must not

  • Must not write the declaration or tick the declaration box
  • Must not write the worker's account of dust exposure or diagnosis
  • Must not upload scans, digital x-rays, CT scans, or a file larger than 10MB
  • Must not submit the application

The lawyer checks

  • The worker is eligible, or the representative is authorised. The page says a solicitor is not required
  • A solicitor must upload proof of identity and the completed authority forms before submitting. A worker may submit before all supporting documents are uploaded
  • The page lists ten groups, ending in a declaration checkbox. The declaration text is not printed on the page and is not described as a statutory declaration
  • Do not upload files larger than 10MB, digital x-rays, or CT scans. Accepted upload types named on the page are PDF, PNG, JPEG, PPT, DOC and XLS
  • Name and date of birth must match the identity documents
  • Health, wage and other personal information stays in a firm-controlled tool. Check confidentiality under ASCR r 9 and APP 11, and whether any breach is notifiable under the Privacy Act 1988 (Cth).

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
