When to use it

Use before a New South Wales insurance-records search, and in Victoria or Queensland where the compensation file may not name the historical insurer. The employer receives it. It does not start a claim and it does not claim against an insurer of a deregistered company.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may prepare this letter from the employment instructions the lawyer has accepted, and the lawyer checks the recipient and sends it.

AI may

  • Name one employer, the years and the sites from the accepted instructions
  • Ask for the insurer, self-insurer or scheme agent, and for the employment records listed
  • Ask the named insurer, if one is already known, to confirm the policy years without making a claim

AI must not

  • Must not assert that the company is deregistered, or claim on an insurer under the Corporations Act 2001 (Cth)
  • Must not call the reply period a statutory deadline
  • Must not describe the client's diagnosis beyond the dust disease the lawyer has recorded
  • Must not attach a medical report unless the lawyer has decided to send it

The lawyer checks

  • The recipient is the employer, or its proper officer, and not a deregistered company unless the lawyer has a current address for service
  • SIRA's form asks for this attempt before a New South Wales search. Keep a copy of the letter as that attempt
  • If an insurer is already named, the confirmation paragraph asks it to confirm the policy. It is not a notice of claim
  • Personal information stays in a firm-approved tool. Australian Solicitors' Conduct Rules rule 9, Australian Privacy Principle 11, and a notifiable-breach check apply
