A file checklist for asking Services Australia for Medicare claims history, a notice of past benefits, or Centrelink information. It points to the official forms, does not replace them, and does not draft any declaration on them.

When to use it

Use when the claim needs Medicare history, a compensation-recovery notice of past benefits, or Centrelink payment details. Send the current official form, not a letter in its place. The client signs the official form.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool may tick which official form is needed from the intake and fill the covering index, and the lawyer checks the current form before the client signs it.

AI may

  • List whether the file needs MS031, MO026, SI039, or more than one
  • Record the date each official form was downloaded from Services Australia
  • Prepare a one-page index of what was sent and what came back

AI must not

  • Must not draft a substitute for MS031, MO026 or SI039
  • Must not write anything in a declaration or signature block on an official form
  • Must not email claim information to an address other than the address on the current form

The lawyer checks

  • The form was downloaded from Services Australia on the day it is used, not taken from an old file
  • The client signs the official form. A young person aged 14 to 17 cannot view Medicare claims history online and uses the claims-information form
  • Centrelink and Medicare information stays in the approved system (APP 11; ASCR r 9). Assess a loss under the Notifiable Data Breaches scheme

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
