When to use it

Use when an injured person, or someone acting for them, asks the National Injury Insurance Agency, Queensland to review an eligibility decision or a treatment, care or support decision within 28 days. A CTP insurer is named on the page only for an eligibility dispute. Do not use this letter for the Workers' Compensation Regulator, and do not use it to draft a QCAT application.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool may prepare this covering letter and a list of the decision and the documents already on the file, and the lawyer settles the grounds and sends the official form.

AI may

  • Record the decision date, the date it was received, and the 28th day
  • Say whether the decision is an eligibility decision or a treatment, care or support decision, using the words on the notice
  • Index the information notice and the reports the notice relied on

AI must not

  • Must not complete or sign the Internal Review Application Form. That PDF was not opened and is not retyped
  • Must not say a CTP insurer can request review of a treatment, care or support decision. The review page does not say that
  • Must not draft a QCAT Form 23, a Medical Assessment Tribunal submission, or any document that is filed
  • Must not use this letter for a Workers' Compensation Regulator review. That covering letter already exists

The lawyer checks

  • Eligibility: the injured person, someone acting for them, or the CTP insurer can dispute. Internal review comes first. The request is within 28 days on the Internal Review Application Form
  • The eligibility page says the internal review is by a senior person in the Agency who did not make the original decision
  • Treatment, care and support: the injured person or someone acting for them can request the review within 28 days of the decision being made, on the same form. An information notice states the reasons and the right of review where funding is refused or approved with conditions
  • The eligibility page's five-step list starts with a decision about treatment, care and support, even though it sits under the eligibility heading. Do not treat that list as eligibility-only. It says the Agency reviews the original decision within 28 days, extensions may occur if further information is required, and the person is told the internal review decision within 14 days of it being made
  • External review of an eligibility decision requires an internal review first. Medical matters go to the Medical Assessment Tribunal. Ask the Agency for a referral within 28 days of the internal review decision, at internalreview@niis.qld.gov.au or GPO Box 1391, Brisbane QLD 4001
  • Non-medical eligibility matters use QCAT Form 23, lodged with QCAT within 28 days of receiving the internal review decision. An example on the page is whether the accident meets the legal definition of a motor vehicle accident. This letter drafts neither
  • The information sheets linked from the review page were not opened. The Act and the Regulation were not opened
  • Health, wage and scheme records stay in the firm's approved tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
