When to use it
Use when a person is an NDIS participant, or is applying, and has received compensation or has a compensation claim. It does not calculate the compensation reduction amount.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may record whether the NDIA has been told, and the dates the file shows. The lawyer decides what the compensation paid for and whether special circumstances are arguable.
AI may
- Record the date of injury, the date the person first used the NDIS, and the date the claim was finalised
- Note which contact path the lawyer has chosen from the list on the page
- Flag that the compensation guideline PDF has not been read into this checklist
AI must not
- Must not calculate a compensation reduction amount or a recoverable amount
- Must not say the calculator figure will be the figure in the plan
- Must not draft the consent form. The form file was not opened
The lawyer checks
- The NDIA was told before the claim was finalised, or the reason it was not
- Supports the NDIA has funded for the injury are listed before any recovery figure is discussed
- A special-circumstances request is made only after the lawyer has the facts the page asks for
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
