When to use it

Use for a Queensland personal injury claim that is not a motor accident claim and not a workers' compensation damages claim, before a court proceeding is started. Check section 6 of the Act for claims the Act does not cover.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool may prepare the covering letter and a table answering each compliance complaint, and the lawyer chooses the respondent, fixes the dates, and writes any statutory declaration the approved form requires.

AI may

  • Place the incident date, the first instruction date and the part 1 due date on the letter from the file
  • List the regulation documents against the documents already held
  • Turn the respondent's section 12 notice into a response table with a gap for each missing fact

AI must not

  • Must not write the words of a statutory declaration. Section 9(1B) allows the approved form to require one
  • Must not decide that the Act applies, or that section 9A rather than section 9 fixes the period
  • Must not treat a motor accident claim or a workers' compensation damages claim as a claim under this Act

The lawyer checks

  • The claim is one to which the Act applies. Motor accident and workers' compensation damages notices are different statutes
  • Part 1 is given by the earlier of the section 9(3) days, and part 2 is diarised under section 9(3A)
  • The respondent's prescribed period is taken from section 12(4) and section 10, not assumed to be one month in every case
  • Health, wage and scheme records stay in the firm's approved tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).
