When to use it

Use when a survivor may already have an offer, a decline, an acceptance or an advance payment, and the firm does not hold the Scheme's record. The Scheme receives the letter. It does not accept, decline, review or reassess an offer.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may prepare this request from the survivor's name and any offer the lawyer already holds, and the lawyer checks it before it is sent.

AI may

  • Ask the Scheme for the date and outcome of an earlier offer, and for any payment including an advance payment
  • Attach an offer letter the firm already holds and ask the Scheme to confirm it
  • Include a short authority, signed by the client, to release that record to the firm

AI must not

  • Must not accept, decline, extend, review or reassess an offer
  • Must not sign an acceptance document, a declining form, a review form, a reassessment agreement or a payment-choice form
  • Must not describe the abuse
  • Must not demand repayment of an advance payment, or admit a debt
  • Must not state a date on which the Scheme closes

The lawyer checks

  • The client wants the record requested, and signs the authority. The authority is not a statutory declaration
  • If an advance payment was made, a later decline can require repayment. That advice is given separately. This letter does not offer to repay
  • The eight-week and four-week periods are the Scheme's time for an institution to answer the Scheme. They are not a deadline this letter imposes
  • The record, once received, is read against Guide 4.8 before anyone is told that a civil claim has been released
  • The request stays in a firm-approved system. Australian Solicitors' Conduct Rules rule 9, Australian Privacy Principle 11, and a notifiable-breach check apply

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
