When to use it

Use before a tool is added to the firm's approved list for health information, and again when the vendor changes the contract or the settings. It does not approve a public chatbot.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool may extract contract clauses into a table for the lawyer, and a lawyer decides whether the product can be approved for health information.

AI may

  • Extract the vendor's clauses on access, training, retention and location into a table with page references
  • List settings that are still on by default
  • Compare the clauses with the conditions in SC Gen 23 paragraph 9A and PIC13 paragraph 10

AI must not

  • Must not recommend that the firm buy the tool, or mark it approved
  • Must not treat a marketing page as the contract
  • Must not approve a public tool for health information

The lawyer checks

  • The contract, not the brochure, is the document that was read, and it stops the vendor using inputs to train a model
  • A privacy impact assessment has been done, and it is diarised for review when the product changes
  • The paragraph 9A and PIC13 paragraph 10 conditions can actually be met for subpoenaed and compelled material, or that material is excluded from the tool

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
