When to use it

Use when a Queensland personal injury claim for a child, or for a person with impaired capacity, is to be settled and the settlement is not valid until sanctioned. The lawyer writes the affidavit, the opinion and the orders that are filed.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The lawyer writes the application, the opinion, the affidavits and the orders; the tool writes nothing into them and may only index the bundle and reconcile figures the lawyer has already accepted.

AI may

  • Index the reports, notices and proof of service the lawyer lists, and mark a Practice Direction step that has no document
  • Reconcile the compromise sum, the statutory charges and the costs estimates against the source notices
  • Record the five-business-day service date once the lawyer nominates the hearing date

AI must not

  • Must not draft or outline the solicitor's affidavit, the litigation guardian's affidavit or statement, counsel's opinion, or the administrator's affidavit
  • Must not write the draft order that is filed
  • Must not put medical reports or the opinion into a public tool

The lawyer checks

  • Section 59 applies, and the sanction is by the court or, if the public trustee is asked to sanction, by the questionnaire on the Public Trustee's page
  • Rule 98 material is produced to the court and is not served on another party unless the court orders otherwise
  • The Public Trustee is served five business days before the hearing unless a shorter time is agreed in writing, and the opinion is not in that bundle
  • Any written submission names the responsible person and the references have been verified, under Practice Direction 5 of 2025
