Where this comes from

The official form is published by nsw.gov.au; this page is a completion guide. Last checked on 2026-10-23.

When to use it

Use when a private manager, already appointed, completes the annual or updated plan for a managed person's estate. This is not the application to NCAT for a financial management order.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool may list assets, debts and one-off amounts already on the file, and it writes nothing in the plan the manager signs or in any statement of the managed person's views.

AI may

  • List real estate, debts, income and a court award or settlement figure from documents already on the file
  • Check a draft against sections A to G and note which appendix sections a proposed change would engage
  • Record the mail address and the page's last-updated date

AI must not

  • Must not write the plan that is submitted, or the manager's consultation answers
  • Must not state the legal effect of section 39 of the NSW Trustee and Guardian Act 2009 or section 14C of the Trustee Act 1925
  • Must not decide a remuneration amount or an investment change
  • Must not submit the plan
  • Must not write the section G acknowledgment that the information in the form is true and correct

The lawyer checks

  • The manager completes all of sections A to G, and only the relevant parts of Appendix A if a change to the estate is requested
  • Section E on the form gives a court award, settlement or inheritance as an example of a one-off receipt
  • Section F says refer to section 39 of the NSW Trustee and Guardian Act 2009. Appendix A asks whether an investment plan complies with section 14C of the Trustee Act 1925. The form's Appendix B sets out text. Do not treat this guide as a statement of those sections
  • Submit on the web page or post to NSW Trustee and Guardian, Locked Bag 5115, Parramatta NSW 2124. The page says the file was last updated on 15 July 2024. Phone 1300 109 290
  • The HTML page has a privacy collection notice covering personal and health information under the Privacy and Personal Information Protection Act 1998 and the Health Records and Information Privacy Act 2002
  • Health, wage and other personal information stays in a firm-controlled tool. Check confidentiality under ASCR r 9 and APP 11, and whether any breach is notifiable under the Privacy Act 1988 (Cth).

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
