When to use it

Use when a Queensland order, or Public Trustee Act 1978 s 59, has the child's damages paid to the Public Trustee. Do not use it for a trust created only by a will, or to draw the sanction order.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

A parent or guardian can be given this note, and the tool does not fill in the Public Trustee's payment form or state a fee figure.

AI may

  • Record that money paid to the public trustee under section 59 is held on trust, subject to a direction of the court.
  • Set out the administration steps the minor-trust page describes, including who is the contact before the child turns 18.
  • Point to the health and education request path, without completing the form.

AI must not

  • Do not state a dollar fee or a percentage. The fees page was not opened.
  • Do not say every damages trust ends at 18. The page says the governing document sets the age.
  • Do not promise that a request for money will be approved.
  • Do not send the child's health records to a public tool.

The lawyer checks

  • Read the order. Section 59 pays the public trustee unless the court directs otherwise.
  • The minor-trust page also covers wills and some statutory compensation. Use this note for the court damages path.
  • Maintenance payments are available only if that trust allows them. Ask the Public Trustee before anyone commits to a bill.
