Where this comes from

The official form is published by vcat.vic.gov.au; this page is a completion guide. Last checked on 2026-10-23.

When to use it

Use when a person wants VCAT to review a TAC decision, instead of or after the TAC's informal review or dispute resolution. The person completes the VCAT form. Check the time limit on the decision letter as well as the TAC page.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool may diary 12 months from the date the person became aware of the decision and index the decision letter; the person completes the VCAT form and the lawyer settles the grounds.

AI may

  • Diary 12 months from the date the lawyer confirms the person became aware of the decision, and also diary the date stated on the decision letter
  • Index the decision letter and the documents the letter relied on
  • Record that the application must name the Act, and that the Transport Accident Act 1986 appears on VCAT's commonly used list

AI must not

  • Must not write the grounds of review or the submissions
  • Must not decide that VCAT has jurisdiction, or that a fee will be waived
  • Must not treat the TAC page's 12 months as overriding a different time limit on the decision letter. The lawyer reconciles the two

The lawyer checks

  • The TAC page says a review may be requested within 12 months of the day the person becomes aware of the decision, instead of or after informal review or dispute resolution
  • VCAT says most review applications have time limits and to check the decision letter. Name the Act on the form
  • The TAC page names the form Application for Review of a Decision, Review and Regulation, completed on the VCAT website or obtained from VCAT on (03) 9628 9700
  • There is a government fee. Fee relief is a separate VCAT form
  • The TAC page says the TAC has 28 days from receiving VCAT's copy to respond. If the TAC asks for more information, the person has 90 days, and the TAC then has 28 days. If the information is not provided in 90 days, the TAC can apply to dismiss
  • VCAT can affirm, vary, set aside and substitute, or set aside and remit, unless the Act gives different powers. VCAT says it cannot accept some cases where a party lives interstate or is a Commonwealth body
  • Health information stays in a firm-controlled tool. Check ASCR r 9, APP 11, and whether any disclosure would be a notifiable breach under the Privacy Act 1988 (Cth).

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
