When to use it

Use when a plaintiff injury matter is ready to close, after judgment or after a settlement the lawyer has settled. Complete the costs disclosure before the settlement is executed. Do not leave that disclosure until this list.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool may list closing steps that are still open on the file, and a lawyer confirms each one before the file is closed or any record is destroyed.

AI may

  • List unpaid bills, unsigned authorities to return, and diary rows still open
  • List uploads to a tool that is not the matter repository
  • Record the date the section 177 or section 312 disclosure was given, if that date is on the file

AI must not

  • Must not draft the settlement, or treat a missing pre-settlement disclosure as something to do for the first time at closure
  • Must not set a destruction date of seven years as a legal minimum
  • Must not delete the matter repository, or original medical records, as part of clearing a tool

The lawyer checks

  • The section 177 or section 312 estimates were given before the settlement was executed
  • Medicare, Centrelink and NDIS steps recorded on the file are finished or still diarised
  • Destruction waits on a risk assessment of when a claim against the firm could accrue, and on any law or order that requires retention
