When to use it

Use when a Queensland damages claim under the Workers' Compensation and Rehabilitation Act 2003 has not settled at the compulsory conference. The client approves an offer that would dispose of the claim if accepted. This is not the notice of claim for damages.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool may assemble this offer from the client's written instructions, and the lawyer fixes the amount and whether a joint or consolidated offer is used before it is given at the conference.

AI may

  • Fill the parties, the claim and the client-approved amount into the offer
  • Keep the period of 10 business days, and the warning that proceedings are not started while the offer is open
  • Leave the joint-offer and consolidated-offer paragraphs out unless the lawyer has marked that those subsections apply
  • Keep the later sealed-envelope step separate from the offer that is given at the conference

AI must not

  • Must not choose or change the amount or the open period
  • Must not state that the offer is exclusive of costs, or insert offer-limit dollar figures. Section 292 does not say that
  • Must not describe this offer as the notice of claim for damages
  • Must not put the offer in a document the court will read before it has decided the claim

The lawyer checks

  • The party has legal capacity to settle, and the offer would dispose of the claim if accepted
  • Section 292(9): the offer stays open for 10 business days, not 14 days, and proceedings are not started while it is open
  • A joint offer needs sufficient notice to the offeree beforehand, under section 292(4)
  • A consolidated offer must cover the related contribution claims to the extent of the offeror's legal capacity, detail the portion for each claim, and be accepted or rejected in full
  • Section 292(13) is the costs provision that was read. It is a regard to the filed offer. It is not the Personal Injuries Proceedings Act costs section
  • Sealed envelopes: the claimant or insurer at the start of the proceeding; another party within 10 business days after service of the process that starts it. The court must not read the offer until it has decided the claim
  • The compulsory-conference attendance section was not opened. Confirm who must attend, and whether the employer has been told, before the conference
  • Section 292 does not state an exclusive-of-costs rule or an offer limit. Do not copy those rules from the other Queensland Acts
  • This is not the notice of claim for damages. Sanction rules and statutory refunds were not opened
