When to use it

Use when the records are held by a Queensland Hospital and Health Service or by Queensland Health, and the patient wants their own health record. Try the health service's administrative access scheme before a formal application.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may prepare the administrative request and, if a formal application is needed, the covering particulars; the lawyer checks the current form, the fee test and the identity evidence before lodgment.

AI may

  • Direct the request to the Hospital and Health Service that treated the patient and ask for administrative access first
  • Limit a formal application to documents that contain the applicant's own personal information, where that is what the instructions ask for
  • List the identity documents the lawyer has already collected, without drafting any declaration

AI must not

  • Must not say that the Information Privacy Act 2009 access path has been repealed
  • Must not invent a prescribed form number, or complete any declaration printed on the agency's form
  • Must not add a request for documents that do not contain the applicant's personal information if the application is being lodged on the no-fee basis
  • Must not put health records into a tool that the firm has not approved for that information

The lawyer checks

  • The health service's current administrative-access scheme has been tried, or there is a recorded reason to make a formal application
  • The current access form is the one published for Right to Information and information privacy applications, and any declaration on it is completed by the applicant, not generated here
  • The fee test is applied to the documents actually sought: the Department of Justice page says there is no application fee for an application seeking only the applicant's own personal information, and no processing charge for an application that contains only that information
  • Identity evidence matches what the Office of the Information Commissioner requires, including a certified copy or an emailed Queensland Digital Licence PDF, and a parent's extra evidence where the records are a child's
  • Health information stays in a firm-approved tool. The lawyer applies Australian Solicitors' Conduct Rules rule 9 and Australian Privacy Principle 11, and considers whether any breach is notifiable under the Privacy Act 1988 (Cth)
