When to use it

Use when a settlement figure is under discussion and the client is to decide whether to accept it. The lawyer writes the recommendation. Do not send it as a substitute for the sanction or approval papers where the client cannot give instructions.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may assemble the dates, the offer terms and the sourced refund figures in a firm-controlled tool; the lawyer writes the liability view, the ranges and the recommendation.

AI may

  • Set out the offer terms from the written offer or the draft deed the lawyer has marked as current
  • Place Medicare and other refund figures beside the notice they come from
  • Leave the recommendation, the ranges and any preclusion length blank

AI must not

  • Must not write the recommendation or a likely outcome
  • Must not invent a preclusion period, a Medicare charge or an NDIS repayment
  • Must not put the medical opinions discussed in this letter into a public tool

The lawyer checks

  • Section 177 or s 312 disclosure, as applicable, is in the letter before the client is asked to sign
  • The net figure is traced to the distribution statement and changes if a notice is still outstanding
  • The client can instruct. If not, this letter is not the vehicle for the decision
  • Victorian Uniform Law text is confirmed if the practice is in Victoria. That instrument was not opened

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
