When to use it

Use when a Queensland workers' compensation insurer is referring, or has referred, a medical matter to a Medical Assessment Tribunal. The worker does not lodge the referral. Do not use it for a court expert report.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool may build the index from the lawyer's documents and calculate nothing, and the lawyer checks the reference type and the 10 business day date.

AI may

  • Assemble the index from the documents the lawyer has selected, with one page sequence.
  • Insert the pathway or forum block the lawyer has selected and remove the others.

AI must not

  • Must not state an impairment percentage, a diagnosis, or whether a statutory threshold is met.
  • Must not put health or wage records into a public or consumer tool.
  • Must not draft an affidavit, a witness statement or a statutory declaration.
  • Must not write the insurer's approved referral form.
  • Must not ask the tribunal for a percentage or draft its decision.
  • Must not copy tribunal documents to the employer unless the employer is the insurer.

The lawyer checks

  • The section 500 paragraph is marked, and sections 160 and 179 have been read if they are the path.
  • The worker's documents go to the tribunal and the insurer at least 10 business days before the hearing.
  • A psychiatric impairment is not given to a non-tribunal specialty to assess.
  • No percentage is stated.

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
