When to use it

Use when a worker wants the Regulator to review a Queensland workers' compensation insurer's decision. The application must be in the approved form. Use the reasons request only if the notice did not state the reasons, and send that request within 20 business days.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The lawyer and the tool draft the grounds and the document list from the decision and the instructions, and the lawyer checks that the decision is reviewable and completes the approved form before it is lodged.

AI may

  • Summarise the decision and the date reasons were received, from the notice
  • Turn the worker's instructions into short grounds for the lawyer to put on the form
  • List the documents to be attached, from the file index the lawyer has marked

AI must not

  • Must not lodge this letter as the application, or sign the approved form
  • Must not write in any declaration or signature block on the form
  • Must not include a ground that is not in the instructions or the documents
  • Must not use the 20 business day reasons request if the notice already stated the reasons

The lawyer checks

  • The decision is one section 540 allows to be reviewed, checked against the notice and WorkSafe's list
  • The 3 months are counted from receipt of the notice and the reasons, or from the later reasons if subsection (4) applies
  • The grounds and the documents are on the approved form, because the review officer does not re-investigate
  • Draft only in the firm's approved tool. In Victoria and New South Wales, do not disclose confidential client information without authority under Australian Solicitors' Conduct Rules r 9.2.1. A Queensland solicitor checks the local conduct rules.
  • If client information leaves the approved environment, check APP 11 and whether there is an eligible data breach under the Privacy Act notifiable data breach scheme.
