Map policy offset clauses against statutory weekly payments and other income

Key facts

YellowClose supervision
How AI is used
From the policy offset clause and the payment summaries the lawyer selects, build a table of each amount, its source, the period, and whether the clause picks it up. The tool does not decide a deduction the clause does not name.
What the lawyer must review
  • Read the offset clause. Apply it only to amounts the clause names.
  • Match each payment to weekly payments, loss of earnings, paid leave or other income.
  • Check the arithmetic against the payment summaries, not the client's memory.
  • Keep medical and wage records in the firm's tool. ASCR r 9 and APP 11 apply.

Checklist

  1. Quote the offset clause from the schedule or the policy wording. Do not use a generic list of offsets.
  2. Keep WorkSafe, SIRA and WorkSafe Queensland weekly payments in separate rows from any transport payment.
  3. Section 3.6 of the Motor Accident Injuries Act 2017 (NSW) is the first 13 weeks only. Do not treat it as the whole of the statutory-benefits period without reading the later sections.
  4. Victorian loss of earnings benefits are fortnightly and, on the Commission's policy, cover the first 18 months.
  5. Clause 5.17 lets a subscribing insurer ask for financial information to assess entitlement or to confirm the amount. The offset is still the words of the policy.
