Letter supporting a victims assistance application

A covering letter to the victims assistance body, sent with the application and the reports the scheme's page asks for. It is not the application form, and a private firm's letter is not a government-funded organisation's report.

When to use it

Use when an application is being lodged with the Victorian Financial Assistance Scheme, Victim Assist Queensland, or New South Wales Victims Services. Delete the state paragraphs that do not apply. Do not use the letter as the application, or as a report from a government-funded organisation.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The lawyer and the tool draft the covering letter from the application and the document list, and the lawyer checks the scheme, the time limit and every enclosed fact before it is sent.

AI may

  • Identify the scheme, the applicant and the type of assistance from the application
  • List only the documents that are actually enclosed
  • Keep one state paragraph and delete the others

AI must not

  • Must not present this letter as the application form
  • Must not write in a declaration or sign the application
  • Must not describe the firm's letter as a report from a government-funded organisation unless that is true
  • Must not state a time limit that the scheme's page does not give for that type of application

The lawyer checks

  • The application is the scheme's own form and the client, or the person the form requires, has signed it
  • The time limit for this applicant and this type of assistance has been diarised from the page that was opened
  • Enclosures match the list, and health records stay in the firm's approved tool
  • Draft only in the firm's approved tool. In Victoria and New South Wales, do not disclose confidential client information without authority under Australian Solicitors' Conduct Rules r 9.2.1. A Queensland solicitor checks the local conduct rules.
  • If client information leaves the approved environment, check APP 11 and whether there is an eligible data breach under the Privacy Act notifiable data breach scheme.

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
