When to use it

Use when a primary victim or a family victim of homicide asks what recognition payment the NSW Victims Support Scheme publishes for their circumstances. The lawyer checks the category against the Act and the evidence. This is not the application and not the victim's account.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may place the facts the lawyer has already accepted beside the categories on the Victims Services page; the lawyer decides the category and whether the application is in time.

AI may

  • Set the published categories out beside a short description the lawyer has already written
  • Enter the incident date, the victim's date of birth and a candidate time limit, flagged for checking

AI must not

  • Must not decide the category or that the person is eligible
  • Must not draft or outline the victim's account of the violence or its impact
  • Must not treat the web page as a substitute for the Victims Rights and Support Act 2013

The lawyer checks

  • The category is checked against the current Act, not only against the web page
  • The time frame on the page is checked against s 40 and any later amendment before the client is told a date
  • Section 25 (people who are not eligible) and s 44 (when support may be declined or reduced) are read before a category is advised

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
