When to use it
Use when a client receives a decision refusing or reducing victims support or a recognition payment under the NSW Act. Start straight away; the 90-day limit runs from notice of the decision.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may compare the decision with the application and evidence and list differences; the lawyer decides the grounds and writes the review application.
AI may
- Set out the decision’s findings beside the application and evidence
- Calculate the 90-day date from notice of the decision
AI must not
- Must not draft, summarise or outline the victim’s own account of the violence or its impact
- Must not write the grounds of review
- Must not lodge the application
The lawyer checks
- The application is lodged within 90 days and states the grounds fully
- The recognition payment category claimed is supported by the evidence
- Any new evidence is ready to go with the application
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
