When to use it

Use when a NSW victims support application may be affected by the victim's or the deceased's conduct, or by money already received. The note records the questions. It does not record a drafted account of the violence.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may list payments and policies already in the documents; the lawyer takes instructions and decides whether s 25 or s 44 is engaged.

AI may

  • List insurance payments, judgments and other amounts shown in documents on the file
  • Set out the two example factors the government page gives under s 44, as examples only

AI must not

  • Must not decide that support will be refused or reduced
  • Must not draft the victim's account or an explanation of their conduct
  • Must not treat the page's two examples as the whole of s 44

The lawyer checks

  • Section 25 and the whole of s 44 have been read, not only the examples on the web page
  • Every other payment is identified with its source and whether it relates to the act of violence
  • The client has approved any description of conduct that will be put to Victims Services

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
