When to use it
Use when acting for a witness who was injured by seeing or hearing an act of violence in Queensland and applies to Victim Assist Queensland for financial assistance.
Used for these tasks
- Prepare the application to a state victims support scheme
- Take the victim's own account of the violence and its impact
- Apply for more time to lodge a victims assistance claim
- Index the police, medical and counselling records for a victims' application
- Work out whether another payment must be notified or assistance repaid
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
The tool may index records of the violence and the witness's expenses for the lawyer to check, and it writes none of the witness's own account.
AI may
- Index police, medical and expense documents with dates and sources
- List other payments shown on the file for the lawyer to check against the declaration questions
- Note whether the witness is a bystander or a person the form tells to use the primary application
AI must not
- Must not write what the witness saw or heard, or how it affected them
- Must not write the declaration of other payments or any signature
- Must not choose between the form's domestic-violence statements, or decide an extension
- Must not write the confirmation that all information in the form is, to the best of the person's knowledge, true and not misleading
The lawyer checks
- Form 9 version 4, effective 14 September 2023, returned in full
- The person saw or heard violence in Queensland and was injured by it
- The primary form is used where the form says children or family members in the home are primary victims
- The work and motor-vehicle gates, and the 3-year question, are answered from the file
- The violence was reported as the form requires, and the client signs
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
