Where this comes from
The official form is published by nsw.gov.au; this page is a completion guide. Last checked on 2026-10-23.
When to use it
Use when a primary victim, a parent or guardian of a child primary victim, or a family victim of homicide asks Victims Services for financial assistance with economic loss. The loss-of-earnings form and the certificate of earnings were not opened.
Used for these tasks
- Build the expenses and income loss schedule for a financial assistance claim
- Build the other-payment reduction table for a victims award
- Sort property damage out of a financial assistance claim
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
The tool may list earnings records and invoices already on the file against the caps printed on the page, and it writes nothing in the application or the account of the violence.
AI may
- List payslips, invoices and receipts already on the file under the cost head the document itself names
- Note whether a loss-of-earnings claim is flagged, so the lawyer can download the current earnings form
- Record money already on the file from workers compensation, insurance, a rebate or a court claim
AI must not
- Must not decide which cap applies or calculate the loss
- Must not write the person's account of what happened, or complete the loss-of-earnings form or the certificate of earnings
- Must not describe those two forms. They were not opened
- Must not sign or lodge the application
The lawyer checks
- The caps are read from the current economic-loss page, opened on 23 October 2026. The page says the amount approved depends on the person's circumstances
- The up-to-$30,000 band is a primary victim of violent crime, a primary victim of modern slavery for acts on or after 1 January 2022, or a parent, step-parent or guardian of a child primary victim. Family victims of homicide are in the up-to-$5,000 band for justice-related expenses
- Heads on the page: loss of earnings up to $20,000; out-of-pocket expenses up to $5,000 if there was no loss of earnings; medical and dental bills up to $30,000; clothes or items carried up to $1,500; court, coronial or other justice-related expenses up to $5,000
- Child sexual assault, as the page states it: no time limit for out-of-pocket and justice-related expenses, and actual loss of earnings, medical and dental bills, and loss or damage to personal items within 2 years of turning 18
- A loss-of-earnings claim needs the claim-for-loss-of-earnings form and a certificate of earnings or a letter from the employer or, if self-employed, the accountant. Those forms were not opened
- Other money, including workers compensation, insurance, rebates and court claims, is documented because the page asks for it and because section 44, which was not opened, is flagged on the page as a ground for reducing support
- Later costs of the same act may be claimed for 5 years after lodgment or until the funds are used. A new act needs a new application
- Health and other personal information stays in a firm-controlled tool. Check confidentiality under ASCR r 9 and APP 11, and whether any breach is notifiable under the Privacy Act 1988 (Cth).
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
