Open at the first instruction from a primary, secondary or family victim seeking financial support or a recognition payment under the NSW scheme, and keep it current until the claim window closes. Check the statutory exceptions before treating any application as out of time.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may enter dates and calculate candidate deadlines from the file; the lawyer confirms the victim category, the applicable time limit and any exception.
AI may
- Enter the dates of the act of violence, the victim’s date of birth, requests and decisions from the file
- Calculate candidate deadlines under ss 40, 41A and 49, flagged for the lawyer to confirm
AI must not
- Must not draft, summarise or outline the victim’s own account of the violence or its impact
- Must not decide the victim category or that an application is out of time
- Must not process police or medical records outside the firm’s approved environment
The lawyer checks
- The victim category and the support sought are right for the facts
- Child victim and family victim rules, and the 10-year limit for recognition payments, have been applied where relevant
- Every deadline is diarised by two people
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
