When to use it
Use when a person receives an offer of redress, or a reassessed offer, under the National Redress Scheme. The decision to accept or decline is the person's, after advice. This checklist does not make that decision and does not contain their account of the abuse.
Used for these tasks
- Advise a survivor on a National Redress Scheme offer
- Prepare a National Redress Scheme application with the survivor
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
The lawyer advises whether to accept; AI may enter the offer date and the acceptance deadline from the letter and list the components of the offer.
AI may
- Enter the date of the offer letter and calculate a candidate end date six months later, flagged for the lawyer to confirm against the letter
- List the components the offer letter says are available
AI must not
- Must not advise the person to accept or decline
- Must not draft the acceptance document or alter its wording
- Must not draft or outline the person's account of the abuse
The lawyer checks
- The acceptance period is taken from the offer letter and part 4.6, and any extension is confirmed in writing
- The person has been offered the free independent legal advice the guide describes, or has chosen private advice
- The release is explained in the words of the guide before anything is signed, including that signing and receipt by the Scheme means the offer cannot then be declined
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
