Letter asking police for a report for a victims application

A letter asking police for a copy of a report or statement about a violent incident, so it can be used with a victims assistance application. It is not the application, and it does not say the scheme must receive the report in every state.

When to use it

Use when a victims application in Victoria, Queensland or New South Wales needs the police record, or the client wants a copy for the file. Do not use it as the application, and do not tell New South Wales Victims Services that a police report must be attached if the incident was reported to NSW Police.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The lawyer and the tool draft the request from the instructions and any event number, and the lawyer checks the state paragraph before it is sent.

AI may

  • Ask for the report, statement or event record the instructions identify
  • Enclose the client's authority and no one else's information
  • Keep the state paragraph that matches where the application will be made, and delete the others

AI must not

  • Must not invent an event number, a report date or a statutory deadline for police to reply
  • Must not tell Victims Services that a New South Wales police report must be attached
  • Must not ask police to create a new account of the incident
  • Must not send this letter as the victims application

The lawyer checks

  • The state paragraph matches the scheme that will receive the application
  • The date for a reply is the lawyer's date, not a statutory limit
  • Any report that arrives is stored in the firm's approved tool
  • Draft only in the firm's approved tool. In Victoria and New South Wales, do not disclose confidential client information without authority under Australian Solicitors' Conduct Rules r 9.2.1. A Queensland solicitor checks the local conduct rules.
  • If client information leaves the approved environment, check APP 11 and whether there is an eligible data breach under the Privacy Act notifiable data breach scheme.
