How AI is used
From the lawyer's register and the documents the lawyer marks, complete the Victims Support Scheme fields for the support sought and the attachments. Do not write what happened to the client.
What the lawyer must review
  • Confirm whether the application is for counselling, financial assistance or a recognition payment
  • Check the published time limit for that support
  • The tool writes nothing about the act of violence

The work product

Forum. NSW Victims Support Scheme, Victims Services

Produce. A draft victims support application with the account of the violence left blank.

Have ready. Lawyer's eligibility register; Report of what happened; Medical, dental or counselling report, if a recognition payment is sought.

Example of the limit. Illustrative example: A primary victim seeks a recognition payment after a violent robbery. The draft lists the report of what happened and notes that the effect report is still to come. It does not choose the $1,500 or another amount. The lawyer checks the two-year limit and the 12-month period for the effect report.

Stop and hand it back when

  • The kind of support is not identified, so the time limit cannot be checked.
  • The draft describes what happened to the client.

Checklist

  1. Separate counselling, which the scheme page says has no time limit, from financial assistance and a recognition payment, which do.
  2. For a recognition payment, use the recognition-payment page: 10 years for domestic violence or sexual assault, 2 years for other violent crime or modern slavery, with the child and homicide variants on that page.
  3. For a primary victim's recognition payment, include a report of what happened and a medical, dental or counselling report showing the effect. If the effect report is not ready, record the published 12-month period to provide it.
  4. If a recognition payment would be approved for a person under 18, record that it is paid to NSW Trustee and Guardian until the person turns 18.
  5. Do not choose a recognition-payment amount. The published amounts turn on the type of violence.
