The work product
Forum. Victim Assist Queensland under the Victims of Crime Assistance Act 2009
Produce. A draft financial assistance application with the account of the violence left blank.
Have ready. Lawyer's eligibility register; Police or other report the lawyer accepts; Medical and expense documents marked for attachment.
Example of the limit. Illustrative example: A primary victim seeks a special assistance payment and recovery expenses. The draft names those payment types and lists the report. It does not describe the violence. The lawyer checks section 54 and whether the Public Trustee must receive the payment.
Stop and hand it back when
- The violence has not been reported in a way the guide accepts.
- The draft describes the act of violence.

Who does what
| Role | What they do |
|---|---|
| Assistance | Do not begin AI assistance until the responsible lawyer has defined and confirmed its permitted scope. |
| Lawyer | Set the scope, supervise the work closely, verify every part relied on, resolve omissions and exceptions, and approve the exact output. |
Checklist
- Confirm whether the applicant is a primary victim, a special primary victim, a related victim, a parent secondary victim or a witness, because the guide gives each a different set of payments.
- Check reporting. All victims except special primary victims must report to police. A special primary victim may report to a doctor, counsellor, psychologist, psychiatrist or domestic violence service.
- Apply section 54: 3 years after the act, 3 years after the death for a related victim, or, for a child, 3 years after the day the child turns 18.
- For violence before 1 December 2009, use the guide's extra eligibility limits, including conviction or a stated police or tribunal outcome. For later violence, a conviction is not required.
- If the victim is under 18 or has an appointed trustee, record that payment goes to the Queensland Public Trustee.
