How AI is used
Record the victim type, the date of the act of violence or the death, whether the victim was a child, the report of the violence, and the section 54 limit the lawyer states, each with its source. Do not choose the limit.
What the lawyer must review
  • Decide which limb of section 54 applies
  • Check the date of the act or the death against a document
  • Diary the deadline, including a child's 21st birthday where that is the limit

Have ready. Date of the act or the death; Client's date of birth; Report of the violence accepted by the lawyer.

Example of the limit. Illustrative example: The client was 16 when the act occurred. The lawyer selects section 54(1)(c). The register records three years after the 18th birthday and the diary date. It does not draft an extension request.

Stop and hand it back when

  • The lawyer has not chosen which limb of section 54 applies.
  • The date of the act or the death is not on a document.

Checklist

  1. Use section 54(1): 3 years after the act, 3 years after the primary victim's death for a related victim, or 3 years after a child turns 18.
  2. Record the guide's matching child rule: a victim under 18 at the time of the violence has until age 21.
  3. Record how the violence was reported. A special primary victim may report to a doctor, counsellor, psychologist, psychiatrist or domestic violence service. Other victims report to police.
  4. If the act was before 1 December 2009, flag the guide's conviction and related limits for the lawyer. Do not treat them as satisfied.
