How AI is used
Index the attachments and compare draft answers with the records. Write nothing into the notice or claim form.
What the lawyer must review
  • You and the client complete every answer. The tool writes none of them
  • Check PIPA section 9(1B) on the current form: the approved form may require a statutory declaration
  • Check the MAIA non-fatal notice and WCRA section 275(5): each requires a statutory declaration
  • Sign a section 275 notice only in the urgent case section 276(3) allows

The work product

Forum. Queensland pre-court notices under the Personal Injuries Proceedings Act 2002, the Motor Accident Insurance Act 1994, or section 275 of the Workers' Compensation and Rehabilitation Act 2003.

Produce. An index of attachments and a comparison of draft answers to the records. The form itself is completed by the lawyer and the client.

Have ready. The current approved form; The records and draft answers; Instructions on the respondent, the insurer and the dates.

Example of the limit. Illustrative example: A draft answer gives a symptom date the records do not state. The lawyer leaves that answer blank for the client and does not let the tool complete the declaration.

Stop and hand it back when

  • The tool is asked to write an answer, a declaration or the law practice certificate.
  • The current approved form has not been downloaded.

Checklist

  1. Choose the pathway. Section 6 takes a Motor Accident Insurance Act injury, and chapter 5 damages against an employer, outside the Personal Injuries Proceedings Act. Dust-related conditions are outside it. A work injury claim against someone other than the employer can still be inside it.
  2. Personal Injuries Proceedings Act part 1 is due on the earlier of two days. The first is the day 9 months after the incident or, if symptoms of the injury were not immediately apparent, the first appearance of symptoms. The second is the day 1 month after the claimant first instructs a law practice to act in seeking damages and the proposed defendant is identified. Part 2 is within two months of the earlier of section 10(1) or the section 13 presumption. Subsections 9(3), (5) and (6) do not apply to abuse of the person as a child. A medical incident has an initial notice under section 9A. If the respondent is the State, part 1 goes to the Crown solicitor and names the department.
  3. Motor Accident Insurance Act section 37: three months for an unidentified vehicle to the Nominal Defendant, otherwise the notice is due on the earlier of two days. The first is the day 9 months after the accident or, if symptoms were not immediately apparent, the first appearance of symptoms. The second is the day 1 month after the claimant first consults a lawyer about the possibility of making a claim. Failure to notify the Nominal Defendant of an unidentified vehicle within nine months bars that claim. The opened non-fatal notice verifies the claimant certificate by statutory declaration.
  4. Workers' Compensation and Rehabilitation Act section 275: the notice goes to the insurer's registered office, with a copy to the employer if the employer is not a self-insurer, within the period in section 302. Statements in the claimant's personal knowledge are verified by statutory declaration. The notice includes the liability statement, a genuine offer or reasons, the section 275(7) authority and the law practice certificate if a practice is retained.
  5. Download the current approved form. The publications dataset says the Personal Injuries Proceedings Act forms in force from 1 September 2025 replace the previous notices. The opened Form 275 was approved on 1 May 2014. Confirm it is still the approved form. Compare every answer with the records before the client signs.

The tool writes nothing into the notice, the claimant's statutory declaration, or the supervising principal's law practice certificate. Supreme Court Practice Direction 5 of 2025 and District Court Practice Direction 12 of 2025 apply to anything later filed.

Section 9(9) says that giving part 1 after symptoms appear does not decide when the cause of action arose. The lawyer still checks the Limitation of Actions Act 1974. The Personal Injuries Proceedings Regulation was not opened.

Form 275, as opened, is declared before a justice of the peace, a commissioner for declarations or a solicitor. Section 276(3) allows the claimant's lawyer to sign where it is not reasonably practicable for the claimant to do so, in that urgent-need section.
