Where this comes from
The official form is published by uscis.gov; this page is a completion guide. Last checked on 2026-10-22.
When to use it
Use when a sponsor must sign the affidavit of support for a person immigrating on a family-based petition, including where Form I-485 is filed online and the I-864 is uploaded with it. Do not use it for an employer-sponsored worker's obligations record.
Used for these tasks
- Build a partner-visa relationship-evidence index
- Draft a partner-visa submission that cites criteria in the Migration Regulations 1994
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
The tool may list which sponsor documents the lawyer has not yet ticked, and it must not draft the affidavit, the income figures or the perjury certification.
AI may
- List whether the edition date, the household-member I-864A question, and a credit-freeze note are still open on the lawyer's checklist
- Remind the lawyer that the page links Form I-864P and that no poverty-guideline figure was copied from it
AI must not
- Must not draft the affidavit, any income or asset figure, or the certification under penalty of perjury
- Must not decide that a sponsor's income is sufficient
- Must not state a poverty-guideline amount. Form I-864P was not opened
- Must not sign for the sponsor, an interpreter or a preparer
The lawyer checks
- The page alert of 31 August 2026 publishes edition 08/24/26 and gives a 30-day grace period for edition 10/17/24. From 1 October 2026 only edition 08/24/26 is accepted. A 10/17/24 edition postmarked or submitted on or after that date will not be processed
- USCIS does not reject Form I-485 merely because it is filed with a previous edition of Form I-864. If an edition other than 08/24/26 is submitted on or after 1 October 2026, USCIS follows 8 CFR 103.2(b)(8) on failure to submit required initial evidence
- Edition 08/24/26 includes a privacy release authorising USCIS to request information from consumer reporting agencies. A credit or security freeze may block that assessment. The sponsor should release it promptly
- If the sponsored person files Form I-485 online, they can upload Form I-864 with Form I-485. The fee, if filed with USCIS, is on the G-1055 fee schedule. No amount is copied here
- A separate Form I-864A is required for each household member or dependent whose income is used, and for each household member using assets other than the intending immigrant. An intending immigrant completes I-864A only if their spouse or children immigrate with them
- A legal guardian who signs must present proof of appointment as guardian of the estate and a court or agency order allowing the guardian to make the income and assets available for the sponsored immigrant
- The opened PDF contains sponsor, interpreter and preparer certifications under penalty of perjury. Several lines in the extract are cut off. Read the current PDF before anyone signs
