When to use it
Use when preparing an employer nomination for a Skills in Demand visa, or the skills-assessment documents that go with a Core Skills stream application. Read the labour agreement if the nomination is under one.
Used for these tasks
- Draft an employer-nomination and sponsored-visa cover pack
- Draft a skills-assessment cover letter and competency narrative
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may turn the sponsor's advertisements and the applicant's documents into this checklist; the practitioner decides whether an exemption applies and settles every sentence that will be lodged.
AI may
- List the two advertisements against the content, medium and four-week tests on the labour market testing page
- Flag a redundancy or retrenchment in the nominated occupation in the four months before lodgement
- List the Core Skills stream documents the visa page names, including a skills-assessment reference number where one is mandatory
AI must not
- Must not decide that an international trade obligation exemption applies, or that no exemption applies
- Must not write the competency narrative, or state that a skills assessment is or is not mandatory, unless the practitioner has checked the instrument the visa page cites
- Must not state a Core Skills Income Threshold dollar amount; the Core Skills stream page does not state one
The lawyer checks
- The stream is Core Skills, Specialist Skills, Employer Sponsored 494, or a labour agreement, because the testing rules differ
- Each advertisement ran in Australia, in English, for at least four weeks inside the four months before nomination, or since the redundancy if that rule applies
- Salary is in the advertisement if annual earnings are lower than AUD96,400, and the medium is one the page accepts
- Any skills assessment required by the page was commenced before the visa application, inside the three-year period the page states
