Where this comes from
The official form is published by uscis.gov; this page is a completion guide. Last checked on 2026-10-22.
When to use it
Use when a conditional permanent resident who obtained status through marriage will apply to remove the conditions, either jointly during the 90-day period immediately before the status expires, or with a waiver ground the current form page lists.
Used for these tasks
- Build a partner-visa relationship-evidence index
- Draft a partner-visa submission that cites criteria in the Migration Regulations 1994
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
The tool may list which joint-filing or waiver evidence the lawyer has not yet ticked, and it must not choose a waiver ground or draft the declaration.
AI may
- Remind the lawyer that the first day of the 90-day window is on the When to File page, which was not opened, so no calendar date is calculated here
- List the five waiver grounds printed on the form page against the ground the lawyer has already selected
AI must not
- Must not decide that the marriage was in good faith or that a waiver ground is met
- Must not draft the petition narrative, the evidence descriptions or the declaration under penalty of perjury
- Must not calculate the first day of the filing window. That page was not opened
- Must not sign for a spouse, a conditional resident or a preparer
The lawyer checks
- The page says to use Form I-751 if you are a conditional permanent resident who obtained status through marriage and want to remove the conditions. The edition date is 04/01/24
- A joint filing is made during the 90-day period immediately before conditional residence expires. Filing before the first day of that window may lead to rejection. The When to File page was not opened
- The page lists five waiver grounds: extreme hardship; a good-faith marriage and later death of the spouse or stepparent; a good-faith marriage ended by annulment or divorce; battery or extreme cruelty by the spouse; and battery or extreme cruelty of a child by a parent or stepparent
- Each waiver path on the page asks for copies showing the marriage was entered in good faith and not to circumvent the immigration laws. The evidence itself is not described here
- The opened PDF contains declarations and preparer certifications under penalty of perjury. Extracted lines are cut off. Read the current PDF. Form I-90 is the wrong form for removing conditions
